Terms of Service for GetSetXplore (GSX)

Welcome to GetSetXplore is an Adventure Fitness readiness platform designed to help you prepare for and engage in physical pursuits. These Terms of Service ("Terms") govern your access to and use of our website https://www.getsetxplore.com and the GetSetXplore Mobile Application (collectively, the "Platform").

By creating an account, booking a trek, or organizing an event on our Platform, you agree to comply with and be legally bound by these Terms. If you do not agree to these Terms, you may not use our Services.

GetSetXplore operates as an intermediary platform providing fitness plans and connecting Adventure Enthusiasts ("Xplorers") with Event Organizers ("Organizers").

1. Account Registration & Eligibility

1.1 Eligibility

You must be at least 18 years old to register and use our Platform. If you are under 18, you may only use the Services with the involvement and consent of a parent or legal guardian.

1.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials (username, password, OTP). You agree to notify us immediately of any unauthorized use of your account.

1.3 User Roles

• Xplorer: A user who browses, books, or participates in events.
• Organizer: A user or entity that lists events, manages bookings, and delivers adventure services. Organizers must provide valid business verification documents upon request.

2. Services, Subscriptions & Payments

2.1 Adventure Event Bookings

When an Xplorer books a Event, they are entering into a direct contract with the Organizer. GetSetXplore acts solely as a technology facilitator.

2.2 Training Plans & Readiness Engine

Our Readiness Engine generates goal-based training plans for marathons, hikes, and adventure activities. These plans are for your personal, non-commercial use only. You are strictly prohibited from sharing, copying, or suggesting these specific training actions to any other person; we encourage you to recommend that others generate their own unique plans tailored to their own baselines and goals. You are solely responsible for the accuracy and completeness of the data you input. Plans adapt based on activity data synced from the app or integrated wearables. You are responsible for ensuring your physical health is sufficient to follow any generated plans.

2.2.1 Subscriptions & Paid Services

• Subscription Models: We offer goal-based, monthly, and annual subscription plans that provide access to training plan creation and adaptation tools.
• Trainer Consultations & Club Events: Users may book paid consultations with professional trainers or participate in weekend events hosted by independent fitness clubs through the Platform.

2.2.2 Payments

All payments are processed through secure third-party gateways (e.g., GooglePay, Razorpay, Cashfree).

• Organizer Payments: As it's directly credited to the organizer's account, the organizer & payment gateway are solely responsible for it.
• Platform Fees: GetSetXplore may charge a convenience fee to Xplorers or a commission to Organizers, which will be clearly displayed before payment.

2.2.3 Cancellations & Refunds

• Organizer Policy: Each event listing displays the Organizer's specific cancellation policy. Refunds are subject to these individual policies.
• Platform Responsibility: GetSetXplore is not responsible for refunding payments directly. Disputes regarding refunds must be resolved directly with the Organizer.

3. Community & User Conduct

3.1 Prohibited Activities

You agree NOT to:

• Use the Platform for any illegal purpose or in violation of any applicable local, national, or international laws.
• Post false, misleading, or defamatory content in reviews or community chats.
• Harass or abuse other users in the In-App Group Chat.
• Bypass the Platform to conduct bookings directly with Organizers.

3.2 Community Interaction

The Platform allows users to create and participate in communities. GetSetXplore is not responsible or liable for any user-to-user interactions, content shared, or disputes occurring within these communities. Users must maintain respectful conduct in accordance with our community guidelines at all times.

3.2.1. Training Plans & Readiness Engine

GetSetXplore offers goal-based training plan generation for marathons, hikes, and adventure activities. Plans are generated based on user-provided data, and users are responsible for the accuracy of this input. The 'Readiness Engine' adapts plans based on activity data synced from the GSX app or integrated wearables if a user misses a scheduled activity. Users may maintain multiple active goals.

3.2.2. Subscriptions & Paid Services

We offer subscriptions in three formats: goal-based, monthly, and annual plans. These subscriptions allow users to create, follow, and adapt their training plans. Additionally, users can book paid consultations with trainers and participate in weekend events hosted by clubs or fitness groups.

3.2.3. Community Features

Users may create their own communities within the app to interact with like-minded individuals. By participating, users agree to maintain respectful conduct in accordance with our community guidelines.

3.3 User-Generated Content

3.3.1. The "Not a Medical Device" Clause (Accuracy Disclaimer)

Accuracy of Activity Data and Non-Medical Use The "Record Activity" feature, including step counts, distances, pace, and route mapping, is provided for informational and recreational purposes only. GetSetXplore does not guarantee the absolute accuracy, reliability, or completeness of this data. The application is not a medical device, and the data provided should not be used for medical diagnostics, treatment, or as a substitute for professional medical advice.

3.3.2. The "Assumption of Risk" Clause (Crucial for Adventure Apps)

Assumption of Physical Risk By utilizing the "Record Activity" functionality for running, cycling, hiking, or other physical pursuits, you acknowledge that outdoor and adventure activities carry inherent risks of property damage, bodily injury, or death. You agree that you are solely responsible for assessing your physical fitness, health, and the environmental conditions before engaging in any tracked activity. GetSetXplore assumes no liability for any injuries or damages sustained while using the tracking features of the app.

3.3.3. The "Fair Use" Clause (For future-proofing)

User Conduct and Data Integrity You agree to use the "Record Activity" feature honestly and as intended. Any attempt to artificially manipulate, spoof, or falsify location data, step counts, or activity metrics to gain unfair advantages, badges, or rewards on the GetSetXplore platform is strictly prohibited and may result in the suspension or termination of your account.

4. Disclaimers & Assumption of Risk

4.1 Assumption of Risk

Adventure sports involve inherent risks, including physical injury, illness, or death due to weather, terrain, or equipment failure. By booking a trek or any event, you voluntarily assume all such risks.

4.2 Platform Liability

GetSetXplore is NOT an Event Organizer. We do not own, operate, or control the treks or events. We are not liable for:

• Any injury, loss, or damage suffered during an event.
• The quality, safety, or legality of the services provided by the Organizer.
• Cancellations due to weather, government orders, or force majeure events.

4.3 Organizer Liability

Organizers are solely responsible for the safety, insurance, and execution of their events. Organizers represent and warrant that they possess all necessary permits, licenses, and insurance required by Indian law to conduct such activities.

5. Intellectual Property

All content, design, graphics, code, and the "GetSetXplore" brand are the intellectual property of GetSetXplore and are protected by copyright and trademark laws. You may not copy, modify, or distribute our content without written permission.

6. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

7. Governing Law & Dispute Resolution

These Terms are governed by Indian law. Disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.

8. Changes to Terms

We may modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the new Terms.
